Domino’s delivery driver receives reduced ban
A man who delivers pizzas for a living has been banned from driving for just one week after being caught speeding at 60mph in a 30mph zone in April last year.
When a driver exceeds the speed limit by this amount, the offence is punishable by 6 penalty points. The driver in question already had 6 points on his licence and therefore faced ‘totting up’ 12 points – the maximum points a driver can receive before facing a driving disqualification of up to 6 months.
The driver used the ‘exceptional hardship’ argument in order to argue that a substantial driving ban would affect his ability to look after his family as he would no longer be able to carry out his job as a delivery driver.
The driver explained that his manager was prepared to allow him a week’s leave in order to serve a punishment. On the basis that a lengthy ban would cause the driver extreme hardship, the Magistrate allowed the short disqualification.
This case highlights the importance of seeking legal advice if you are charged with a driving offence. We will assess your case and advise you on whether you could potentially successfully argue exceptional hardship to reduce, or even avoid, a driving ban.
