CODE FOR PRIVATE PROSECUTORS
The Private Prosecutors’ Association has now published a Code for Private Prosecutors, the aim of which is to set a benchmark for best practice in relation to the conduct of private prosecutions.
The purpose of this new Code is to provide guidance for those involved in private prosecutions on client engagement, investigation, disclosure of documents, charging and proceedings, abuse of process, trial, sentencing and costs.
The Code looks to deal with issues which are not covered by the Code for Crown Prosecutors and, at the moment, the Code is voluntary.
The guidance is very much welcomed, given the extreme growth in private prosecutions, and at Chadwick Lawrence we expect this upward trend to continue due to the lack of resources available to those in the public sector.
The Code is, however, of optional status and it remains to be seen whether in the future it is given statutory or judicial weight.
