Pedestrian awarded £28,000.00 in tripping accident
In May 2015 the Claimant was walking along a pavement in her local town when she tripped and fell as a result of a defect in the pavement, which caused her serious injury to her shoulder.
The Claimant required surgery to repair the serious fracture to her shoulder. A claim for damages was made on the Claimant’s behalf by Yorkshire’s Injury Lawyers against the local highway authority, in this case a large Council.
A breach of Section 41 of the Highways Act 1980 was alleged in that the Council failed to maintain the highway. After due investigation the Council concerned admitted liability subject to medical evidence proving that the Claimant’s injuries were caused by the accident.
Medical records were obtained regarding the Claimant’s injuries from the Hospital where the Claimant was treated. The Claimant was then examined by an Orthopaedic Surgeon specialising in shoulder surgery and an opinion was provided which suggested that the Claimant who was already retired would continue to require assistance with heavier domestic tasks indefinitely.
Negotiations were entered into which produced initial offers from the Defendants in the region of £20,000.00, thereafter gradually increasing until an amount of £28,000.00 was agreed for the Claimant’s damages, just over 12 months after the claim was first made.
