Section 106 Agreements


Section 106 Agreements are often used by Local Authorities as part of granting planning permission – they usually require a developer to make a financial contribution to the Local Authority to assist it in providing for the local community in some way.

This may include contributions to improve traffic management around the development site, local nursery facilities or affordable housing. Any requirements will need to be reasonable and linked to the development, among other requirements.

If you are required to enter into a Section 106 Agreement as part of your planning approval, you should consider having legal advice on the contents of the agreement, so that you have fully understand the extent of your obligations and can identify any potential issues early on.
